Terms & Conditions

These terms govern access to and use of BotWorks. By creating an account or using the Service, you agree to them.

Last updated: 26 September 2026

1. Agreement

These Terms & Conditions ("Terms") are a binding agreement between [Company Legal Name] ("Provider", "we", "us") and you ("Customer", "you") for use of the BotWorks platform, website, and related services (collectively, the "Service"). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

Our Privacy Policy describes how we handle personal data and is incorporated by reference.

2. The Service

BotWorks is a multi-tenant software platform that helps you connect WhatsApp Business accounts via Meta's Cloud API, build conversation flows, manage keyword rules, operate a shared inbox, run bulk template campaigns (where enabled), and related automation. Features may change; we may add, modify, or discontinue features with reasonable notice where practicable.

3. Account registration and security

  • You must provide accurate registration information and keep credentials confidential.
  • You are responsible for all activity under your account and workspace.
  • You must notify us promptly of unauthorised access via our contact channels.
  • We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. WhatsApp, Meta, and messaging compliance

Use of WhatsApp features requires a valid Meta Business and WhatsApp Business account and compliance with Meta's WhatsApp Business Messaging Policy, Commerce Policy, and Cloud API terms. You agree that:

  • You will send messages only to users who have opted in or where another lawful basis applies, and you will honour opt-out requests promptly.
  • Marketing and promotional messages will use approved templates and categories as required by Meta and applicable law (including India's telecom and commercial communication rules where relevant).
  • You will not use the Service for spam, phishing, illegal content, harassment, or messages prohibited by Meta or law.
  • You are solely responsible for the content of messages, recipient lists, and consent records for your end users; we provide tools but do not verify your legal compliance.
  • Meta may limit, suspend, or revoke WhatsApp access independently of us; we are not liable for Meta's actions or API outages.

5. Bulk campaigns and recipient data

When you upload or enter phone numbers for bulk sending, you warrant that you have the right to process those numbers and to message those individuals in compliance with the DPDP Act, Meta policies, and other applicable regulations. You will not use purchased lists without proper consent. You are the data fiduciary (or authorised processor) for your recipients' data; we process it only to deliver sends you initiate.

6. Acceptable use

You will not:

  • Reverse engineer, scrape, or overload the Service except as permitted by law.
  • Circumvent rate limits, authentication, or tenant isolation.
  • Store or transmit malware or attempt unauthorised access to other tenants' data.
  • Use the Service in violation of export control, sanctions, or anti-spam laws.
  • Misrepresent your identity or affiliation.

7. Customer content and intellectual property

You retain ownership of content you submit (flows, messages, contact data). You grant us a limited licence to host, process, and transmit that content solely to provide and improve the Service. We retain all rights in the platform, software, branding, and documentation.

8. Fees

If we offer paid plans, fees and billing terms will be presented separately. Unless stated otherwise, fees are non-refundable except where required by law. You remain responsible for charges from Meta, carriers, or third parties you connect.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, DELIVERY OF MESSAGES, OR META API AVAILABILITY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN India, NEITHER PARTY SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR INR 10,000, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (INCLUDING FRAUD OR WILLFUL MISCONDUCT).

11. Indemnity

You will indemnify and hold us harmless from claims, fines, and expenses arising from your use of the Service, your messages or recipient lists, violation of Meta or WhatsApp policies, or breach of these Terms, except to the extent caused by our gross negligence or wilful breach.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breach, legal requirement, or extended inactivity. Upon termination, your right to use the Service ends; we may delete or retain data as described in our Privacy Policy.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts at the location of our registered office ([Registered office address, City, State, PIN Code, India]) shall have exclusive jurisdiction, subject to mandatory consumer protections where applicable. You may also raise grievances related to personal data with our Grievance Officer at [grievance@yourcompany.com].

14. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, you must stop using the Service.
